Abstrakt

DOES LEGAL THEORY HAVE AN IDENTITY? ON LAW AND COLLECTIVE MEMORIES

The question asked in the text concerns the relations between law, its identity and collective memories. Legal theoreticians as well as legal historians overlooked the problem of mutual relations between law as a system of norms and collective identity based on some form of collective memory.
The aim of the text is to formulate the problem and present some terminological concepts as well as typology of relations. The text is a preliminary exploration of fascinating issues bordering between legal history and theory and sociology.
