Abstract

The purpose of the article is outlining the circumstances which serve as the grounds for adopting resolutions by the regional council of the Chamber of Legal Advisers regarding the denial of entry in the bar of legal advisers on the basis of Art. 24 para. 2c s. 1 from the Act of the 6 July 1982 on legal advisers, on the basis of warranty premises regarding the proper pursuit of a legal advising occupation in case law. Every prerequisite of entry in the bar… is independent and of equal status and only their combined fulfilling makes the entry possible. When arbitrating the entry case, adviser authorities are entitled to an independent evaluation of whether a candidate fulfills all the prerequisites on the basis of collected evidence. The arbitrating authorities fulfill the constitutional obligation of custody over the proper pursuit of a legal advising occupation, as far as the public interest and the protection of the advising profession are concerned.
