EMPLOYER AS A SUBJECT OF CIVIL LAW RELATIONS
Polish law grants the ability to hire employees to internal organizational units of legal and statutory persons. At the same time, they can not have a civil legal capacity necessary to perform property legal transactions under an employment relationship and participate in civil law relationships inseparably related to the employment of employees. Neither doctrine nor judicial decisions have found a logical solution to this contradiction. For these reasons, it is necessary to postulate a return to the concept that an employer may only be a civil law person.
