The entry into force of the Act of 12 March 2022 on assistance to citizens of Ukraine in connection with an armed conflict on the territory of this country was dictated by a higher raison d’etat, i.e. the need to provide support to neighbors (Ukrainians) due to the unexpected military attack of the Russian Federation on the inhabitants this country. Even though this act was created very quickly (within two weeks of the outbreak of the war), it defines its subjective scope precisely and clearly.
In the first part of the article, it was decided to describe the subjective scope of the aid act and although this legal act applies to Ukrainian citizens crossing the Polish border due to military operations carried out in Ukraine, not every citizen of this country is its addressee. This Act contains four legal conditions that must be met in order to be the recipient of the legal act in question, in particular:
The absence of any of the above legal conditions deprives the foreigner of the opportunity to benefit from the aid act. The Ukrainian special act is dedicated (as its title states) to Ukrainian citizens who are seeking help from Poland in connection with the armed conflict caused by the Russian Federation on the territory of Ukraine.
In a short time, the Ukrainian special act underwent several changes, and the most important of them was the change of 15 April 2022, establishing Art. 100c and the amendment of 1 January 2023 establishing Art. 100d. Both of these legal provisions enabled voivods to suspend the deadlines for residence cases for foreigners, and deprived foreigners themselves of the right to submit reminders and court complaints regarding inactivity or excessive delay in the actions of voivods.
These changes to the Act on Assistance to Citizens of Ukraine gave rise to dualism in the jurisprudence of Polish administrative courts. Over the last year, court judgments have begun to be contradictory and contrary to the idea of a democratic state of law that implements the principles of social justice. The same issue is assessed differently by the Polish judiciary. On the one hand, administrative courts rightly stated that the Ukrainian special act and its legal provisions were established only for Ukrainian citizens who came to Poland after the outbreak of the war in Ukraine. On the other hand, administrative courts wrongly stated that parts of the Ukrainian special act, specifically Art. 100c and art. 100d, apply to all foreigners. It should be strongly emphasized here that the fragmentary application of the law is an incorrect practice. The positive premises of the aid act cannot be applied only to Ukrainian citizens and the negative premises cannot be applied to all foreigners.
Only proper understanding and interpretation of legal issues regarding the entry and stay in Poland of Ukrainian citizens and other foreigners gives a chance to respect the rule of law. The Ukrainian special act is intended to support and protect Ukrainian citizens, but cannot discriminate against foreigners from other countries of origin.
