Characteristics of the evidentiary agreement — selected issues (part I)

Abstract

The study discusses a new institution in the Polish system of civil procedural law — the evidentiary agreement. The first part presents the definition of an evidentiary agreement, the issue of its admissibility before the amendment to the Code of Civil Procedure by the Act of 4 July 2019, the time of its conclusion and content, as well as the legal nature of the evidentiary agreement. The conducted research may enable a more complete understanding of this institution and at the same time make it easier for the parties to conclude appropriate agreements and for the courts to make a more accurate assessment.
