Social law in German and Polish legal doctrine

Abstract

Social law is a separate field of law in the German legal order. It is distinctive in its specificity and basic structure. It is an extremely elaborate system, the origins of which can be traced to the social reforms of the Wilhelminian era. Meanwhile, in Polish legal doctrine and legal writing, the category of social law does not have such a long tradition. Historically, Polish legal science related the law defining the social position of the citizen to the implementation of “social policy.” Nowadays however, the Polish scholarly output takes a lot of inspiration from the German doctrine of social law, and there are attempts to determine the designations of social law in Polish legal doctrine.
