Abstract

A philosophical reflection is needed on public economic law, and in particular the determin-ation of the values underlying this dogma. The values should first be properly identified and their sources determined. The problem is their degree of acceptance by the legislator expressed in the content of statutory norms and the role and importance of values in the process of applying the law. Values determine governance in the area of the economy, affect relations between state authorities and entrepreneurs, as well as the sphere of business activity. They constitute a necessary premise for formulating the principles of law. The freedom to conduct business activity properly configured with the need to pursue the public interest are the values characterising and distinguishing public economic law.
