The aim of the article is to analyze the permit to run a business in the form of a facility providing 24-hour care for persons with disabilities, chronically ill or elderly persons, which is an instrument of the regulatory function of public administration. Another aim of the article is to formulate de lege lata and de lege ferenda conclusions on prerequisite conditions for issuing and revoking the permit to run a facility providing 24-hour care specified in the Act of 12 March 2004 on Social Welfare and sanctions for running a business in the form of a facility without a permit and in violation of service standards in the facilities.
