Protection of sporting event organisers in the digital environment — the search for new legal solutions in the European Union

Abstract

Sport is increasingly important in the economy. The development of new technologies, in par-ticular high-speed internet, increases the possibility of broadcasting sporting events by their viewers. Thus, a collision of interests arises between the sporting event organisers and their viewers, who broadcast these events available on various websites, while benefiting from it. The aim of the article is to outline the search for legal solutions in relation to the organisers of sporting events at the EU level. In particular, the draft provision of art. 12a will be presented, which was included in the draft EU directive on copyright in the digital single market. Although this provision was not included in the final text of the adopted directive, the history of this regulation shows that the issue of protection of organisers of sporting events will keep coming back.
