Professional Activity of an Economic Operator in Public Procurement Law

Abstract

In view of the fact that the term “professional activity” has not been clarified on the grounds of the Public Procurement Law, it is necessary to reflect on its meaning and content, as well as to establish its relationship with the contractor for a public contract. It follows from provisions outside the sphere of the Public Procurement Law that professional activity may be understood as a set of activities with a specific subject matter, and also as a specific business activity and activities carried out on the basis of a civil law contract or an employment contract. Professional activity is also a set of activities of a specific economic operator who has the rights, including qualifications and professional capacity, to perform a specific public contract.
