Abstract

 

The consequences of evasion of serving a penalty of restriction of liberty

The aim of this article is to describe the corollary of evasion of serving a penalty of restriction of liberty, which is converting the penalty of restriction of liberty to replacement penalty of imprisonment.
First of all, the author describes all the premises of ordering the execution of a replacement penalty of imprisonment and elaborates on the term of “evasion” of serving a penalty of restriction of liberty. Further the principles of the replacing a penalty of restriction of liberty with replacement penalty of imprisonment are indicated. The author also analysed the procedure of ordering the execution of replacement penalty of imprisonment. Afterwards there is description of the rules and regulations regarding the execution of replacement penalty of imprisonment. Finally the author focuses on suspension of execution of replacement penalty of imprisonment and the consequences of further evasion of execution of the penalty of restriction of liberty.
