Procedural rules for sharing (transferring) information for re-use

Abstract

The procedure for making public sector information available for re-use, despite its reference to access regulations and reliance on u.d.i.p. regulations, is governed by its own rules. Most of them have been identified by the legislator and defined as best practices. A significant part of these rules is similar to the access rules (rules from the u.d.i.p. regulations). However, it is not infrequently apparent, as it boils down to the legislator’s use of an identical nomenclature — naming. The very way of regulation, the substantive content, and in particular their interpretation gives different results than the analysis of the u.d.i.p. regulations, determining the rules of conduct. This study is devoted to the classification and discussion of the procedural rules of proceeding in the case of making information available for re-use.
