Obligation to bear fees for municipal waste management — selected problems
The issues concerning fees for municipal waste management and their enforcement evoke many doubts, particularly in the municipal context. Changes to the power of the authorities concerning the execution of fees, introduce unwanted chaos, both legal and organizational. How-ever, some of the changes deserve approval, first and foremost the newly defined concept of property owner and several ordering issues, such as the principle of bearing proportional fees to various municipalities in the event of the change of residence, or abandoning the obligation to bear an increased fee in the case of simultaneous conducting of economic activity and living in one premise.
The article both analyses selected issues on the basis of regulations newly introduced by the amendment to the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, which entered into force on 1 February 2015 in arange on 18 April 2015 as well as assesses the said amendment.
