Abstract

Sometimes due to the existence of circumstances specified by law, the parental authority of the child’s parents is limited. Legal foundations are contained in both the provisions of the Family and Guardianship Code, as well as in non-codex regulations. Pursuant to the regulations contained in the Family and Guardianship Code, parental authority may be limited as a result of a court decision, court interference in the exercise of parental authority or by virtue of law. The principle of protecting the child’s welfare is particularly important in this context. Restrictions that a family court may apply on the basis of a separate procedure have been specified in the Act on proceedings in juvenile cases.
