A legislative drafter is a person who drafts the rules of law. In Poland, the term legislative drafter is little known in this sense of the word. In various sources, the legislative drafter is referred to as an employee of the state apparatus or a lawyer. Therefore, the aim of this article is to try to answer the question of whether the legislative drafter is a public servant or lawyer. The author presents arguments in favour of recognizing the legislative drafter as a public servant and lawyer. These arguments are based on Polish law and scientific literature. On their basis, the answer to the question asked is ambiguous. As a result, the main conclusion of this study is that the legislative drafter is both a public servant and lawyer.
