Abstract

The purpose of the article is to point out the inadequacies of legal regulations for isolating the perpetrator of domestic violence from the victims. Domestic violence is a problem that strongly affects society as a whole. Selected areas of inefficiency in the application of legal regulations are analyzed in practical terms. Particularly noteworthy are the issues of ineffectiveness of crisis intervention and its economic conditions, especially in connection with alcohol abuse by the perpetrator. Given the possibility of serving the sentence at home, the subjectivity of juvenile household members becomes another practical problem. An order for the accused to leave the dwelling is usually effective, but there is no sanction for violating it. The power of the police to issue an order to immediately leave a jointly occupied dwelling or a restraining order against the dwelling and its immediate surroundings is a necessary legal tool. The actual enforcement of the punishment is an important element in the fight against domestic violence.
