Abstrakt

Transfer of EU Institutional Patterns Europeanisation of Gender Law in Poland

This paper seeks to employ the concept of Europeanisation and accompanying analytical tools mechanisms of Europeanisation and conditionality into the study of gender law in Poland. Europeanization is conventionally understood as a phenomenon of domestic adaptation to European integration. Consequently, academic attention highlights this process in order to describe, explain and interpret this ‘regulatory intervention’. Europeanisation as analytical concept has gained a lot of explanatory potential together with the process of dynamic growth of research and investigation devoted to it. In its empirical part, this articles focuses on the transfer of EU model in gender policy: legislation, institutions, practices, ranging from the screening phase of accession negotiations to contemporary institutional and procedural set up. The concept of gender mainstreaming as a horizontal EU policy plays a fundamental role and finds its place in the analysis in historical evolutionary perspective. In concluding remarks the authors notice the lack of the linear diffusion of EU norms in the prospective policy but rather a mediated process engaging supraand sub-national actors.
