Constitutional guarantees of media freedom in the German legal system

Abstract

The right to freedom of expression in Germany dates back to 1848 and is considered as one of the most important fundamental rights. Currently, freedom of expression is enshrined in article 5 of the Basic Law. It forms the constitutional basis for the undisturbed functioning of all media in Germany based on independence and pluralism. The significance of freedom of expression for the development of a democratic state observing the rule of law has been repeatedly emphasised by the Federal Constitutional Court in its judgements.
